Empower Kids Network Terms of Use

Last updated: September 2, 2026

1. Scope and Electronic Agreement

These Terms of Use (“Terms”) govern the public website, information, Family Support Request, and other website features made available by Empower Kids Network (“EKN,” “we,” “us,” or “our”).

You may read general public information without being required to create an account.

When a form presents a conspicuous statement that selecting a submission button constitutes agreement to these Terms, selecting that button after the Terms are presented or linked constitutes your affirmative electronic agreement to the version in effect at that time.

EKN may maintain reasonable electronic records of the date, time, language, and version of the Terms and authorization associated with a submission.

The Privacy Notice describes EKN’s information practices. Acknowledging the Privacy Notice is different from providing any separate consent or authorization required for a particular use or disclosure of information.

Additional programs or services may have additional terms or authorizations.

2. What Empower Kids Network Is

EKN is a coordination and collaboration network intended to help families identify and connect with independent organizations, professionals, programs, and community resources.

EKN may help a family understand available categories of support, identify potentially relevant resources, facilitate an introduction or referral, follow up on a requested connection, and organize basic coordination.

EKN is not represented by this website as the direct provider of every medical, therapy, education, transportation, social-service, spiritual, or other regulated service referenced on the site.

Independent organizations remain responsible for their own services, professional judgment, licensure and regulatory compliance, admissions and eligibility decisions, privacy practices, pricing and billing, insurance participation, availability, and outcomes.

3. Not an Emergency Service

The website, Family Support Request, email inbox, and EKN coordination process are not emergency-response systems.

Do not use the website to request emergency medical, psychiatric, safety, or law-enforcement assistance.

If you or another person may be in immediate danger or needs urgent emergency assistance in the United States, call 911 or contact the appropriate emergency service.

EKN does not guarantee that a website submission, email, call, text, or other message will be reviewed immediately.

4. No Medical, Legal, Educational, or Other Professional Advice

Website information is provided for general informational, navigation, and coordination purposes.

Nothing on the website creates a physician-patient, therapist-patient, attorney-client, school-student, fiduciary, or other licensed professional relationship between you and EKN.

EKN does not, through the public website, diagnose medical conditions, prescribe treatment, determine what treatment a child requires, provide legal advice, determine school eligibility, guarantee insurance coverage, or replace advice from a qualified professional responsible for your situation.

You are responsible for obtaining appropriate professional advice when needed.

5. Family Support Requests and Coordination Authorization

The Family Support Request is intended to help EKN understand how to contact you, your location, the type of support you are seeking, and limited context reasonably useful for coordination.

The Family Support form includes a separate required authorization for collection, use, and limited sharing of information for the requested coordination service.

By submitting the form after providing that authorization, you are asking EKN to provide coordination and to use the information you provide only as described in the authorization and Privacy Notice.

You represent that information you submit is accurate to the best of your knowledge, you are authorized to provide the information, and if you provide information about another person, you have an appropriate lawful basis to do so.

The form is intended for adults such as parents, legal guardians, caregivers, family members, or other persons responsibly assisting a family.

Do not use the Family Support form to submit medical records, detailed diagnoses, medication lists, Social Security numbers, financial-account credentials, health-insurance/member identification numbers, or other records not reasonably necessary for initial coordination.

Submitting a request does not guarantee that EKN can identify an appropriate resource, that an organization will respond, that a provider has availability, that a child or family meets eligibility requirements, that insurance or another payer will cover a service, that an appointment, admission, placement, benefit, or referral will occur, or any particular clinical, educational, social, or financial result.

6. Independent Organizations, Referrals, and Third-Party Resources

EKN may identify, describe, link to, contact, or introduce independent organizations and resources.

Unless EKN expressly states otherwise based on verified information, a listing, link, referral, introduction, or mention is not a guarantee, certification, endorsement, representation, or warranty regarding an organization’s quality, suitability, licensure status, availability, pricing, insurance participation, eligibility decisions, or outcomes.

You are responsible for evaluating whether an independent organization is appropriate for your needs and for reviewing its own terms, privacy practices, consent forms, financial arrangements, professional documentation, and service requirements.

EKN is not responsible for an independent organization’s acts or omissions merely because EKN provided information about the organization or facilitated contact.

7. Communications

If you provide contact information and request follow-up, EKN may contact you regarding that request using the contact information and preferences you provided.

Service and coordination communications are separate from promotional communications and optional general EKN updates.

Where applicable law requires separate consent for a particular communication channel or marketing activity, EKN will seek that consent separately.

EKN does not guarantee that email, telephone, text, WhatsApp, or another third-party communications service is always secure, available, or delivered without delay.

8. Privacy

EKN’s handling of personal information is described in the Empower Kids Network Privacy Notice.

The Family Support coordination authorization is separate from optional marketing choices.

Nothing in these Terms expands EKN’s authority to use or disclose Family Support information beyond the authorization, Privacy Notice, and applicable law.

9. Acceptable Use

You may use the website for lawful informational, family-support, community, and collaboration purposes.

You may not:

  • attempt to gain unauthorized access to the website, forms, accounts, infrastructure, or related systems;
  • submit malicious code;
  • use bots or automated systems to abuse the Family Support workflow;
  • send spam or intentionally false requests;
  • interfere with website availability or security;
  • impersonate another person or organization;
  • knowingly submit personal information you have no right to provide;
  • harass, threaten, exploit, or unlawfully discriminate against another person;
  • unlawfully scrape or collect personal information;
  • misuse EKN’s name, logos, materials, or content in a way that falsely implies authorization, endorsement, or partnership; or
  • use the website for an unlawful purpose.

EKN may restrict access, block abusive activity, close fraudulent or malicious requests, and preserve relevant information where reasonably necessary to protect users, systems, or legal rights.

10. Intellectual Property

Unless otherwise indicated, original EKN website text, branding, logos, graphics, design elements, and related materials are owned by or licensed to EKN and protected by applicable law.

You may access and use public website content for legitimate personal, family, informational, educational, and community purposes.

You may not sell, falsely brand, reproduce commercially, or exploit EKN materials in a manner that violates applicable rights or falsely implies affiliation with EKN.

Third-party names, marks, photographs, and materials remain the property of their respective owners.

11. Accessibility

EKN is working toward WCAG 2.2 Level AA as its target accessibility standard.

EKN’s current accessibility approach and contact information for reporting accessibility barriers are described in the Accessibility Statement.

If you cannot access information or a website function, contact EKN so we can work to provide a reasonable alternative when practical.

12. Website Availability, Accuracy, and Changes

EKN may change, correct, suspend, or remove website content or functionality.

The website may become temporarily unavailable because of maintenance, hosting or telecommunications failures, Internet outages, security incidents, software failures, third-party service interruptions, or other events outside EKN’s reasonable control.

EKN makes reasonable efforts to provide useful and accurate information but does not guarantee that every resource description, link, eligibility statement, availability indication, or other third-party detail is always complete, current, or error-free.

13. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the public website, website content, and coordination features are provided on an “as available” and “as is” basis.

Except for obligations that cannot lawfully be excluded, EKN disclaims implied warranties arising solely from use of the public website, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent such disclaimers are legally permitted and applicable.

Nothing in these Terms limits responsibilities that cannot lawfully be waived or disclaimed.

14. Limitation of Liability

To the fullest extent permitted by applicable law, EKN will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the public website.

EKN is not responsible for the independent acts or omissions, professional decisions, services, clinical or educational outcomes, admissions or eligibility decisions, pricing or billing, insurance determinations, privacy practices, or availability of a third-party organization merely because EKN provided information about or facilitated contact with that organization.

Nothing in this section excludes liability that applicable law does not permit EKN to exclude.

15. Limited Indemnification for Intentional Misuse

To the extent permitted by law, you agree to defend and indemnify EKN and the persons or legal entities lawfully operating EKN, together with their personnel, volunteers, representatives, and agents, from third-party claims, losses, liabilities, or reasonable costs arising directly from your intentional unlawful misuse of the website, malicious interference with EKN systems, knowing impersonation, knowing infringement of another person’s rights through your use of the website, or knowing submission of information that you had no right to provide.

This provision does not require a family seeking assistance in good faith to indemnify EKN merely because a referral is unsuccessful, a resource is unavailable, eligibility is denied, or information provided in good faith later proves incomplete.

16. Events Outside Reasonable Control

EKN is not responsible for delay or failure caused by events outside its reasonable control, including telecommunications outages, Internet failures, failures of independent service providers, natural disasters, governmental actions, widespread cybersecurity incidents, labor disruptions, or similar events, except where applicable law requires otherwise.

17. Informal Dispute Resolution

Before filing a civil claim arising primarily from use of the public website or these Terms, you and EKN should make a reasonable good-faith effort to resolve the issue informally.

You may begin that process by contacting info@empowerkidsnetwork.org and providing enough information for EKN to understand and evaluate the concern.

This section does not prevent a person from seeking emergency relief or exercising a right that applicable law does not permit these Terms to delay or waive.

18. Electronic Records and Communications

You agree that website submissions, confirmations, notices, authorizations, agreements, and related records may be created and maintained electronically.

Where legally permitted, electronic records may be used to document the date and time of a submission, the language used, the version of these Terms, the version of an authorization, and other information reasonably necessary to document the transaction.

19. Assignment, Organizational Succession, No Waiver, and Entire Agreement

EKN may assign or transfer these Terms and related website rights and obligations to the legal entity formed to operate Empower Kids Network or to a lawful successor in connection with a merger, reorganization, transfer, or similar organizational event, subject to applicable law and privacy obligations.

Failure to enforce a provision on one occasion does not waive the right to enforce that provision later.

These Terms, together with any form-specific authorization and any additional terms expressly applicable to a particular service, constitute the agreement governing that use of the website.

20. Changes to these Terms

EKN may update these Terms as the website and organization evolve.

The published Terms will display an effective date or last-updated date.

If EKN introduces a materially different service that requires affirmative agreement to additional or different terms, those terms should be presented at the relevant point in the user journey.

21. Governing Law and Venue

To the extent permitted by applicable law, these Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

To the extent a dispute arising primarily from these Terms or the public website may lawfully be required to proceed in a particular forum, the intended venue is the state or federal courts with appropriate jurisdiction located in Miami-Dade County, Florida.

Nothing in this section overrides a law that gives a consumer or other person a non-waivable right to proceed elsewhere.

22. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.

23. Language

The English, Spanish, and Haitian Creole versions of these Terms are intended to communicate the same agreement.

To the extent permitted by applicable law, if a material inconsistency exists among the English, Spanish, and Haitian Creole versions, the English version will control.

EKN should correct any identified translation discrepancy promptly.

These Terms do not currently require mandatory arbitration, waive class-action rights, or waive the right to a jury trial. If EKN later considers those provisions, they should receive specific Florida legal review and be presented through conspicuous affirmative assent rather than inserted as hidden boilerplate.
